2880.0200GROUNDSFORNONRENEWAL.
Noinsurershallrefusetorenewapolicyofhomeownersinsuranceunlessbasedonone
ormorereasonswhichshallbelimitedtothefollowing:
A.ThereasonsstatedforcancellationinMinnesotaStatutes,section65A.01,
subdivision3a.
B.Useofthepremisesforanillegalactivity.
C.Theterminationofanagencycontract,exceptasprovidedunderMinnesota
Statutes,section60A.171,unlesstheinsurerassignstheterminatedagent'sbookofbusiness
toanotheragent.Theinsurermusttransferthepolicytoanotheragentiftheinsuredmakes
awrittenrequestpriortothenonrenewaldate.Noticationofthisrightmustbeincluded
inthenonrenewalnotice.
D.Violationsoflocallawsorordinanceswhichincreasethepossibilityofaloss.
E.Refusaloftheinsuredtoeliminateknownconditionswhichincreasethe
potentialforlossafternoticationbytheinsurerthattheconditionmustberemoved.
Beforeanonrenewalnoticecanbeissuedunderthisitem,twowrittenrequestsstating
theconditiontoremoveandthereasonwhytheconditionincreasesthepotentialforloss
mustbesenttotheinsured.Therstnoticemustinformtheinsuredastoanytimelimits
forcompliance.Thesecondnoticemustinformtheinsuredoftheintenttononrenewthe
policyiftheconditionisnotremoved.
F.Asubstantialchangeinthequalityoravailabilityofreprotectionservices.
G.Iftheinsuredhastwoormorelossesduringtheexperienceperiod,butnotto
include:
(1)lossescausedbynaturalcausesincludingbutnotlimitedtolightning,
wind,orhail;or
(2)lossesforwhichnopaymentwasmadebytheinsurer;or
(3)lossesforwhichtheinsurerrecovers80percentormoreofthepayment
throughsubrogation.
H.TheinsurerceasestowritehomeownersinsuranceinMinnesota.
I.Failureofthenamedinsuredtoprovidenecessaryunderwritinginformation
uponwrittenrequestfromtheinsurer,providedthatbeforeanonrenewalnoticecanbe
issuedunderthisitem,twowrittenrequestsaskingfortheinformationmustbesenttothe
insuredstatingthereasonswhytheinformationisnecessary.Thesecondrequestmust
informtheinsuredoftheintenttononrenewthepolicyiftheinformationisnotreceived.
J.Ifrealpropertytaxesowingontheinsuredpropertyhavebeendelinquentfor
twoormoreyearsandcontinuedelinquentatthetimenoticeofnonrenewalisissued.

K.Thenamedinsurednolongerownsthepropertyorresidesattheinsured
location,unlessthespouseresidesattheinsuredlocationandretainsownership,inwhich
eventthespousewillbeendorsedontothepolicyasthenamedinsured.
Ifaninsurerhasgroundstononrenewahomeownerspolicyonaprimaryresidence
ofanamedinsured,homeownerspoliciesonsecondaryresidencesoftheinsuredmayalso
benonrenewed.Groundsfornonrenewinghomeownerspoliciesonsecondaryresidences
cannotbeusedtononrenewahomeownerspolicyontheprimaryresidence.Ifaninsured
failstorenewtheprimaryresidencewithaninsurer,theinsurermaynonrenewthesecondary
residence.
